She was found guilty of throwing her newborn son into a dumpster in Jan. 2022.<br \/>\n<img loading=\"lazy\" decoding=\"async\" class=\"\" src=\"https:\/\/dims.apnews.com\/dims4\/default\/3489907\/2147483647\/strip\/true\/crop\/702x467+0+17\/resize\/320x213!\/quality\/90\/?url=https%3A%2F%2Fstorage.googleapis.com%2Fafs-prod%2Fmedia%2Fcd783df146fc4399a80596a1bd479a74%2F702.jpeg\" alt=\"New Mexico woman accused of abandoning newborn in dumpster | AP News\" width=\"580\" height=\"386\" \/><\/p>\n<p class=\"text | article-text\">The sentence came down from Judge William Shoobridge after a jury convicted her of attempted first degree murder and child abuse causing great bodily harm two weeks ago.<\/p>\n<p class=\"text | article-text\">Shoobridge heard closing arguments on Monday. The State argued that, despite Avila\u2019s mental illnesses, the crime was intentional and violent. The State said Avila showed no remorse for her actions until she heard the guilty verdict.<\/p>\n<p class=\"text | article-text\">\u201cYour Honor, what we see here is a pattern of someone who is not only showing remorse, but someone who, in fact, takes deliberate steps in her own recollection of this event to minimize her own role,\u201d Attorney General Deputy of Prosecution Mark Probasco said. \u201cIt\u2019s something that was manifest and clear in the video, which was that she was attempting to kill the most innocent life, the most helpless life, of her own child.\u201d<\/p>\n<p class=\"text | article-text\">The court also heard from the baby\u2019s father, Stephen Astorga, who spoke on his son\u2019s behalf.<\/p>\n<p class=\"text | article-text\">\u201cMy son, my healthy, my loving and handsome baby boy, he is never going to forget the things you did,\u201d Stephen Astorga said. \u201cBut, for that I can say that my son will be somebody one day, no matter how much he has been through.\u201d<\/p>\n<p class=\"text | article-text\">Then it was the defense\u2019s turn.<\/p>\n<p class=\"text | article-text\">Domingo Avila, the defendant\u2019s father, stated she was raised in a loving home and he hopes to one day be a part of his grandson\u2019s life.<\/p>\n<div class=\"arc-ad | d-flex flex-column ad-type-flex-leaderboard ad-article-inline include-disclaimer justify-content-center text-center\">\n<div class=\"arc-ad-wrapper |\">\n<div id=\"ad-yHebYIhNzAst5HvhTRdwOJanamLeT_TbXwWNzlTLEaMoqt-6Wo\" class=\"kcbd\/web\/news\/state\/new-mexico arcad bg-light py-3 px-3-sm mt-3 mb-3\" data-google-query-id=\"CJ38_f3xj48DFUNHHQkdHjo6vA\">\n<div id=\"google_ads_iframe_\/63316753\/kcbd\/web\/news\/state\/new-mexico_4__container__\"><img decoding=\"async\" src=\"https:\/\/hips.hearstapps.com\/vidthumb\/c8ddb7bd-09d3-44ed-8ee1-69146d076213\/11646b12-6e33-4d9a-9e14-81c3aac797d7.jpg?crop=1xw%3A1.0xh%3Bcenter%2Ctop&amp;resize=810%3A*&amp;quality=70\" alt=\"Alexis Avila sentenced to 16 years for throwing baby in dumpster\" \/><\/div>\n<\/div>\n<\/div>\n<\/div>\n<p class=\"text | article-text\">\u201cI also pray very much that one day we get the chance to meet our grandson, baby Saul, your honor, I ask that you please have mercy on her soul,\u201d Domingo Avila said.<\/p>\n<p class=\"text | article-text\">Alexis Avila was the last person to speak in court on Monday. During her statement, she cried while apologizing to her son and her <a href=\"https:\/\/lingerrose.com\/?p=81\">family<\/a> for her actions.<\/p>\n<p class=\"text | article-text\">\u201cI regret that I deprived him of having a loving and caring family,\u201d she stated. \u201cYes, he has his dad, and he also has his dad\u2019s family, but when my family and I love, we love hard and we love with everything we can. To my family, family is everything to us. My nephews and my niece are everything to myself and my parents.\u201d<\/p>\n<p class=\"text | article-text\">Shoobridge announced Avila\u2019s 16-year prison sentence will be followed by two years of probation.
